Pääsy IEL-tietokantaan katkolla – kuinka toimia jos sopimusta ei synny? | Access to IEL database at risk – what to do if it will be cut off?

Itä-Suomen yliopiston kirjastolla on ollut jo vuosien ajan FinELib-konsortion kautta neuvoteltu käyttöoikeussopimus IEEE:n tuottamaan sähkö- ja tietotekniikan alan IEL-tietokantaan. Lisenssi antaa kaikille yliopistolaisille pääsyn tietokannan sisältämään aineistoon sopimukseen neuvotelluin käyttöehdoin. Nykyinen sopimus umpeutuu vuoden lopussa.

Sopimuksen uusimisesta on käyty neuvotteluja syksyn aikana. Valitettavasti kustantaja (IEEE) teki FinELib-konsortiolle epärealistisen ja ylihinnoitellun tarjouksen, jota konsortio ei voinut hyväksyä.

Kustantaja kieltäytyy tekemästä konsortiolle parempaa tarjousta ja vaatii sen sijaan yliopiston kirjastoa neuvottelemaan oman sopimuksen. Kustantaja on kertonut, että mikäli kirjasto ei tee omaa sopimusta, lähestyy kustantaja seuraavaksi yksittäisiä tutkijoita neuvotellakseen yksilöllisistä ratkaisuista heidän kanssaan.

Kirjastolle esitetty oma sopimus on aineiston käyttö- ja muilta sopimusehdoiltaan merkittävästi huonompi kuin nykyinen konsortiosopimus.

Kirjasto haluaa edelleenkin palvella IEL-aineistoa tarvitsevia asiakkaitaan parhaalla mahdollisella tavalla. Kirjasto pyrkii osana konsortiota kaikin tavoin saamaan kustantajan takaisin neuvottelupöytään. Kirjasto vaatii, että kustantaja tarjoaa aineiston kohtuullisella hinnalla ja hyväksyttävillä sopimusehdoilla FinELib-konsortion kautta. On selvää, että neuvottelupöydässä FinELib-konsortion jäsenet yhdessä ovat vahvempia kuin yksittäinen kirjasto tai tutkija. Katso lisää IEL-tilanteesta FinELib-konsortion verkkosivuilta.

Varautuminen mahdollisesti tulevaan sopimuksettomaan tilaan on aloitettu. FinELib on laatinut Alternative access –suunnitelman, johon on koottu vinkkejä siitä, millaisia keinoja tutkijat, opettajat ja opiskelijat voivat käyttää artikkelien hankkimiseen tilanteessa, jossa haluttu artikkeli ei löydy organisaation tilaamista aineistoista.

The University of Eastern Finland Library has held a license to the IEEE’s electrical engineering and computer science database IEL for a years. The license has been acquired via the FinELib-consortium. The license grants access to the materials included in the database to our university community under the negotiated terms. The current agreement expires at the end of this year.

Negotiations to renew the consortium contract have been ongoing this fall. Unfortunately the publisher (IEEE) made a consortium offer that was unrealistic and overpriced. The offer was unacceptable to the FinELib-consortium.

The publisher refuses to make a revised offer to the consortium. Instead the publisher demands that the university library negotiates its own contract. The publisher has stated that if the library refuses to do this the publisher will begin to contact researchers to discuss individual solutions with them.

The direct contract offer the publisher has made to the library contains terms (e.g. permitted uses) that are far less favorable to the library customers than those in the current consortium agreement.

The library continues to want to provide the best possible service to its customers who need the IEL-database. The library as part of the consortium will make every effort to persuade the publisher back to the negotiating table. The library demands that the publisher must offer both reasonable pricing and acceptable contract terms via the FinELib-consortium. It’s obvious that together the consortium members are a stronger negotiating partner to the publisher than each library or researcher alone. More about the IEL-situation at the FinELib-website.

Preparations have begun for the possible period when no agreement is in force. FinELib has prepared an Alternative access plan including tips on how researchers, teachers and students can access articles if the article cannot be found in the collections that the organisation has subscribed to.
